The Client and the Provider, each intending to be legally bound, agree that:

Photo Shoot and Makeup Session will be provided on October 20, 2024.

2. Additional information will be sent to you once we receive your signed Agreement.
3. Please arrive on time- before your session.
4. $350.00 balance due at session due via Venmo or Cash. Session to include makeup and photo shoot- up to 1.5 hours total.

5. The sessions are set up on a tight schedule. If you arrive late for an appointment, time may be reduced from your session. The Provider reserves the right to turn away a client if they arrive 15+ minutes late.

6. Termination By Client: Client agrees to provide a non-refundable $100 deposit and a signed Agreement in order to reserve the dates and times of the event. Cancellation within 48 hours of shoot day will result in a $250 late cancellation fee due via Venmo. If client no shows, they are responsible for full remaining balance of $350
7. Termination By Provider: If Contractor cannot provide service according to the Agreement due to casualty, severe sickness, “act of god”, or any other circumstance beyond control, Contractor may terminate the Agreement at any time by returning Client’s retainer and giving written notice of such termination and refund to Client. In such a case, Contractor shall have no further liability to Client with respect to this Agreement. Contractor will make every effort to secure a replacement photographer/MUA to cover the event. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of any payments already received for the Event.

8. Copyright and Publication Rights: The Contractor shall retain ownership of photos. If the client posts on any form of social media and uses photos by MaggieBoo Photography, the client must credit photos and tag in photo and caption @MAGGIEBOOPHOTOGRAPHY and @SHARIDDOESMAKEUP. If posted to social media, images cannot be screen shot because this alters the integrity of the photos. If posting photos on social media there can be no more altering of photos. This includes but is not limited to additional use of filters, screenshotting, presets, zooming in, cropping, etc.

9. Artistic Style: On its own behalf, and on behalf of the subject: Client acknowledges that they are familiar with the Contractor’s portfolio and is requesting services with knowledge of the Contractor’s style, and that the Contractor’s work is constantly evolving. The Client acknowledges that the Contractor’s services are of unique and artistic nature and that the photos may be different from photographs taken by the Contractor in the past, and that in creating the photos, the Contractor shall use her personal artistic judgment to create images consistent with her personal vision of the Event, which may be different from the Client’s and/or the Subject’s vision of the Event. Accordingly, Client acknowledges that the Photos shall not be subject to rejection on the basis of taste or aesthetic criteria.
10. Image Delivery: All finished images will be delivered in an online gallery. From
said gallery, Client can download the High-Resolution images. Photos can be shared from the gallery to social media platforms. Client agrees to download their images as quickly as they can and acknowledges that their gallery may eventually expire or become restricted if they do not.
11. Miscellaneous: All notices hereunder shall be in writing. This Agreement constitutes the entire Agreement between the parties. All modifications must be in writing. If any provision of this Agreement shall be held invalid, the remaining provisions of this Agreement shall remain in full force and effect. Any infringements of this Agreement contract may violate federal law.
12. Expedited editing is available upon request to Maggie Boo Photography for additional charge.

13. Photobooks available upon request to Shari Dutkin for additional charge.
